
Todd S. McGarvey

Todd McGarvey focuses his practice on defending both private and public entities in employment disputes and high-stakes personal injury cases. He has deep experience handling claims of discrimination, harassment, and retaliation under Title VII, the ADA, the New Jersey Law Against Discrimination (LAD), and the Conscientious Employee Protection Act (CEPA). In the personal injury arena, Mr. McGarvey regularly defends clients in complex tort cases involving catastrophic injuries. He recently tried to verdict a high-stakes sexual abuse case after a three-week jury trial.
Mr. McGarvey is a familiar face in New Jersey courtrooms, frequently appearing before federal and state trial courts, the Appellate Division, and the New Jersey Supreme Court. His courtroom experience and strategic approach make him a strong advocate at every stage of litigation.
Before joining Shah Law Group, Mr. McGarvey honed his defense skills at a leading Philadelphia law firm, representing businesses and individuals in toxic tort, products liability, and premises liability cases.
- C.S. & G v. Bridgewater-Raritan Reg’l Sch. Dist. Bd. of Educ., 2023 N.J. Super. Unpub. LEXIS 175 (App. Div. Feb. 8, 2023), cert denied, 294 A.3d 265 (2023): obtained summary judgment dismissing LAD discrimination and hostile school environment claims against a guidance counselor and school district. Successfully defended the judgment on appeal.
- C.W. v. Roselle Bd. of Educ., 474 N.J. Super. 644 (App. Div. 2023): successfully defended on appeal the trial court’s interlocutory order dismissing former student’s claim for pain and suffering damages for failure to show medical expenses in excess of $3600.
- Successfully defended a $2.5 million arbitration demand arising out of a playground accident involving catastrophic personal injuries sustained by a 10-year-old boy.
- Obtained defense and indemnification for a school district from a contractor and its insurer in connection with a wrongful death suit bought by the estate and decedents of a 39-year-old construction worker.
